These Terms of Service (“Terms”) form a legally binding agreement between you and Minseva Team (“we”, “us”, “our”) governing your use of the Minseva application and related services (the “Services”).
1) Eligibility (17+)
The Services are intended for users aged 17 and older. By using the Services, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
2) The Services
Minseva helps you organize your day by capturing thoughts, tracking mood, and providing tools to help you stay focused and reflect on progress. The Services may include optional AI-assisted features that generate insights or summaries based on inputs you choose to provide.
3) Account Registration and Security
- Account info: name, username, and email address may be required.
- Security: keep credentials confidential; you are responsible for activity under your account.
- Notice: contact us if you believe your account is compromised.
4) User Content
“User Content” means content you submit, upload, or otherwise provide through the Services (for example: notes, mood entries, images, or support messages). You retain ownership of your User Content.
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display User Content only to the extent necessary to operate, provide, maintain, and improve the Services and to comply with law.
You are responsible for your User Content and represent that you have the rights to submit it.
5) AI-Assisted Features (Optional)
- You control whether to upload text or images for processing.
- When server-side processing is required, it occurs on servers operated by Minseva Team.
- We do not share uploaded text/images with third parties for AI processing.
- Uploaded text/images are deleted promptly after processing completes.
- We do not use uploaded text/images to train machine learning models.
AI outputs may be inaccurate or incomplete. Use your judgment, especially for important decisions.
6) Acceptable Use
You agree not to:
- Use the Services in a way that violates any applicable law or regulation.
- Upload unlawful, harmful, harassing, defamatory, obscene, or otherwise objectionable content.
- Infringe intellectual property or privacy rights of others.
- Attempt unauthorized access or disrupt the Services (including malware or overload attempts).
- Reverse engineer or extract source code except where prohibited by law.
7) Fees and Purchases (If Any)
If paid features are offered, additional terms may apply at the point of purchase. Purchases made through the App Store are governed by Apple’s terms and your App Store account settings.
8) Intellectual Property
The Services and associated materials are owned by Minseva Team or its licensors and protected by applicable intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Services for personal, non-commercial use in accordance with these Terms.
9) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
We do not warrant that the Services will be uninterrupted, error-free, or secure, or that defects will be corrected. Minseva does not provide medical, mental health, legal, or financial advice. Any mood tracking or insights are for informational and self-reflection purposes only.
10) Limitation of Liability
To the maximum extent permitted by law, Minseva Team is not liable for indirect, incidental, special, consequential, or punitive damages.
To the maximum extent permitted by law, our total liability for all claims relating to the Services will not exceed the amount you paid to Minseva Team for the Services in the 12 months before the event giving rise to the claim, or USD $50 if you have not paid any amounts.
11) Termination
We may suspend or terminate access if you violate these Terms or if suspension is reasonably necessary to protect the Services, users, or our rights. You may stop using the Services at any time and may request account deletion via available in-app controls (if provided) or by contacting us.
12) Changes
We may modify the Services or these Terms from time to time. If we make material changes, we will provide notice within the App or by other appropriate means. Continued use after the effective date means you accept the updated Terms.
13) Governing Law and Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of Minseva Team’s principal place of business, excluding conflict of laws rules.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration rather than in court, except that either party may seek relief in small claims court (if eligible) or seek injunctive relief for misuse of intellectual property or unauthorized access.
Arbitration will be conducted in English by a recognized arbitration institution under its applicable rules then in effect. The arbitrator’s decision is final and binding, and judgment may be entered in any court of competent jurisdiction.
